On 22 August 2024, the Disciplinary Tribunal (DT) of the Chartered Governance Institute UK & Ireland (CGIUKI) found proven the following allegations against Ms Ginette Louise Blondel of St. Peter Port, Guernsey.
Allegations
- Early this year, the Institute received the outcome of an investigation by the Guernsey Financial Services Commission (GFSC) into the member and commenced disciplinary proceedings. The report, which was publicly available, detailed the penalties imposed on the member by the GFSC (taken directly from the GFSC report):
“Imposed a financial penalty of £210,000 on the member under section 39(1) of the Enforcement Powers Law;
Made a Prohibition Order under section 33(1) of the Enforcement Powers Law prohibiting Ms Blondel from holding the position of controller, director, partner, manager, money laundering reporting officer and money laundering compliance officer for a period of 9 years and 1 month;
Pursuant to section 32 of the Enforcement Powers Law to disapply the exemption set out in section 3(1)(g) of the Fiduciaries Law in respect of Ms Blondel for a period of 9 years and 1 month; and
Made a public statement under section 38(1) of the Enforcement Powers Law.”
Disciplinary Process
- The matter was dealt with under the Institute’s disciplinary process and a disciplinary hearing in August 2024, the DT concluded that by reason of her conduct, the member is:
- Guilty of misconduct pursuant to Byelaw 23.8 (c): failing to uphold the code of professional conduct and ethics.
- Guilty of misconduct pursuant to Byelaw 23.8 (d): behaving, by doing something or not doing something, in a way that may be considered by the Disciplinary Tribunal to bring the Institute or the profession into disrepute.
- The member chose not to attend, or be represented at, the hearing but was notified of it in accordance with the Institute’s Byelaws and the Disciplinary Regulations.
- The DT ordered that the member be expelled, and their name removed from the membership register permanently.
- No appeal was received with 28 days of the decision being communicated to the member, so the matter is now closed.
