On 22 March 2019, Statutory Instrument S.I No 110 of 2019, the European Union (Anti-Money Laundering: Beneficial Ownership of Corporate Entities) Regulations 2019 were introduced.
These regulations build on the scope of regulations introduced in November 2016, which required Irish incorporated companies (unless exempt) to create and maintain a register of their beneficial owners. From 22 June 2019 onwards, in addition to the requirement to have a Beneficial Ownership Register, filings are now required to be made on a new online Central Register open to the public.
This CPD event provided an overview of the legislative requirements for companies and trusts which meet the criteria under the regulations and the practical steps Company Secretaries need to take to ensure their companies are ready to meet the statutory obligations.
Experts also provided an insight in respect to the Central Register’s effect on the the funds sector touching on management companies, unit trusts and ICAVs together with details in respect to register inspections and the potential sanctions.
